Ward’s Wallet Watch

Introduction
Ward’s Wallet Watch is a Financial Coach business and provides, via your Coach, financial planning services as described in paragraph 3 below. These constitute the “Services.”
The terms and conditions of receiving, using and distributing the Services are set out below. These are the “Terms” under which Ward’s Wallet Watch provides its Services.
The Services are provided to “Members” (described in paragraph 1. below) of Ward’s Wallet Watch. At times Ward’s Wallet Watch employees may provide partial Service to non-members, for example as part of an introductory offer, these Terms are applicable to all in receipt of the Services.
Please read these Terms carefully before using the Service. By continuing and using the Services or otherwise indicating agreement to continue, you agree to comply with and be bound by these Terms. This agreement is a “Contract” and constitutes a binding Contract between you and Ward’s Wallet Watch.

A. General Terms
1. Key definitions
In these Terms the following definitions shall apply:
“Ward’s Wallet Watch” refers both to the company Ward’s Wallet Watch, who will handle your membership and the Coach assigned to you.
“Coach” refers to the person handling your Financial Coaching.
“Member” and “Wallet Watcher” refer to you once you have paid your membership fee for such a time as your membership is considered active.
“Service(s)” refers to the activities set out in paragraph 3 below.
“Financial Plan” refers to one of the Services described in paragraph 3.1.1.
“Financial Coaching” refers to one of the Services described in paragraph 3.1.2.
“Start Date” refers to the day your membership fees clear in Ward’s Wallet Watch’s account and signifies the date on which your access to the Services begin.
“End Date” refers to the day your membership ceases to apply unless further funds are cleared and signifies the date on which your access to the Services ends.
“Resident” as in 'you must be resident of the UK, is defined as a person who has their main home in the United Kingdom, who is registered with a medical practitioner in the UK, and who has been resident in the UK for 6 months out of the last 12.
“you,” “your,” “yours” refers to the person reading this relating to the Services they have paid membership for.
“website” refers to www.wardswalletwatch.com and all, content, pages, domains and sub-domains contained within it.
2. Information about Ward’s Wallet Watch and how to contact
2.1. If you wish to contact Ward’s Wallet Watch you may use one of these forms of contact:

2.2. By using any part of the Service, including contacting Ward’s Wallet Watch, you agree you can by contacted in any form by Ward’s Wallet Watch for the purpose of providing Services to you, including via your Coach.
2.3.Ward’s Wallet Watch operates a referral Service. If you give us the contact information of any other person you agree that you have ensured they are content to be contacted by Ward’s Wallet Watch for the purpose of providing Services to them.
2.4. Ward’s Wallet Watch communicates in English.
3. The Services
3.1. Ward’s Wallet Watch provides the following activities under the umbrella of Services.
3.1.1. Financial Planning Service – this service involves generating a forecast based on the information provided by the Member and as close an estimation of the future as the Coach can provide. This service requires access to the Member’s entire financial profile. By becoming a Member you agree to Ward’s Wallet Watch holding your financial data. You understand that any plan for the future requires an element of prediction that is not guaranteed and if you withhold any element of your finances the Financial Plan will not be as accurate as it could be through no fault of the Coach.
3.1.2. Financial Coaching – this service is provided by your Coach. You agree to being contacted and being honest with yourself and your Coach in order to move forward through your membership. Your Coach will make you aware of different financial options you could take via e-mail, phone, video message or in person, the choice to take one of those options rests with you but once you advise your Coach of your decision they will do all they can to encourage, motivate and otherwise get you to your target.
3.1.3. Generic Information sharing – this service will see you in receipt of e-mails of a generic nature. Not everything will be relevant to you but some information will. Ward’s Wallet Watch believes it’s useful for you to see all the information but you can opt out if you so desire.
3.1.4. Payment service – this service will be provided via direct debit, bank or cash transfer. Ward’s Wallet Watch agrees that once the money has been paid your membership is active and you are considered a Wallet Watcher with access to the full Ward’s Wallet Watch Service.
3.1.4. Reminder Service - this service will provide you with reminders of upcoming yearly expenses and will remain active even if your membership is not considered active. You will be given the option to opt-in to numerous reminders including, but not limited to, MOTs, utility renewals, the end of fixed term on a mortgage. These reminders will be sent by email up to 6 weeks prior to the date you are being reminded of.
3.2. Access to the Services will be provided in different ways, by SMS, phone, e-mail, written or in person.
4. Offers
4.1. At times Ward’s Wallet Watch may offer discounts or other special offers. All Ward’s Wallet Watch offers are subject to availability and we reserve the right to withdraw any of our offers at any point in time. Certain offers may be subject to additional terms and conditions, which will be highlighted to the user at the time the offer is made. Any extra terms will be additional to these terms and conditions and not in place of.
5. Access to the Services
5.1. To access or use any of Ward’s Wallet Watch Services you must have an active membership.
5.2.Your access to aforementioned Services is included for the time frame activated in the cost of your membership.
5.3. In order to become a Member and use the Services you must be resident in the UK, be 18 or older and have the power to enter into a contract with Ward’s Wallet Watch.
5.4. Ward’s Wallet Watch will make arrangements with you during your first meeting (either in person or by phone) regarding accessing the Services.
5.5. Ward’s Wallet Watch will give you written permission to access the services, in person or via e-mail (if arranged by phone), detailing your Membership’s start and end date and all the contact information of your Coach.
5.6. You agree to the immediate provision of Services from the start date.
5.7.You will retain access to all of the Services for the duration of your membership, in accordance with these Terms.
6. Membership Fee
6.1. The standard fee for an annual membership is £250, payable before the provision of Services, or monthly payments of £25, due each month by the closest working day to the monthly anniversary date of your membership.
6.2. A monthly membership generates a 6 month contract. At the end of the 6 months if you wish to extend to a year Ward’s Wallet Watch requires a one off payment of £125 or continuing monthly payments of £25, payable before provision of Services.
6.3. Ward’s Wallet Watch operates a case by case basis. In the event this membership charge is outside of your capacity you can present your case to Ward’s Wallet Watch and an arrangement may be made. In this case a separate condition will be made, specific to you, and sent in your confirmation e-mail. You understand you will not present this separate condition to any other person in any event.
6.4. Ward’s Wallet Watch reserves the right to alter its membership fee at any time. Current Members will be alerted of changes and how it affects them. No active memberships will be affected until their membership’s end date when renewal will reflect current fees.
6.5. Ward’s Wallet Watch operates a No Gain, No Pain scheme wherein your membership will be refunded, at the end of a year’s paid membership, should the value of your wealth decline below the value generated by your financial plan using the information provided at your first meeting. If you falsely provide any information, at any point the No Gain, No Pain condition it will not be valid. No Gain, No Pain is also subject to you following the guidance provided you by Ward’s Wallet Watch. Failing to act upon the Services is not the same as the Services failing you.
7. Your obligations
7.1. You agree that you will not share any information the Services gives you access to in the same way as you would expect Ward’s Wallet Watch to maintain confidentiality.
7.2. You agree not to duplicate, replicate or in any way copy any information, software, hardware or resources Ward’s Wallet Watch provides you.
7.3. You agree not to behave in a threatening or aggressive manner towards Ward’s Wallet Watch.
7.4. You agree that failure to comply with any conditions within these, and any surplus, terms and conditions may suspended temporarily or terminate your membership without reimbursement. You agree that Ward’s Wallet Watch assumes no liability for any loss or damage arising from your failure to comply with any of the terms and conditions.
7.5. You agree to pay the Membership Fee via cash, direct debit or bank transfer directly through the bank to Ward’s Wallet Watch. Your membership will begin immediately upon Ward’s Wallet Watch receiving these funds and will continue through the term of membership included within those funds, but if Ward’s Wallet Watch does not receive payment of the Membership Fee within seven (7) days of the due date, you agree to pay the Membership Fee in full by direct debit. 7.6. If you fail to make payment by direct debit within seven (7) days of being requested to do so by Ward’s Wallet Watch, Ward’s Wallet Watch reserves the right to terminate or suspend your membership with immediate effect and without any further notice to you.
8. Termination of, or restriction to, the Services
8.1. You agree that Ward’s Wallet Watch, in its sole discretion, has the right to delete, suspend or deactivate your access to the Services immediately and without notice and remove and discard any content within the Website for any reason, including, without limitation, if Ward’s Wallet Watch believes that you have acted inconsistently with the letter or spirit of these Terms.
8.2. You agree that Ward’s Wallet Watch shall not be liable to you or any third-party for any termination or restriction of your access to the Services.
8.3. Consequences of termination of the Services by Ward’s Wallet Watch or cancellation or non-renewal of a membership include access to the Services immediately ceasing, you will no longer have access to Coaching or to your Financial Plan. Depending on the context of the termination you may still receive renewal reminders as laid out in paragraph 3.1.4. There will be no reimbursement of unspent membership fees.
9. Accuracy of information and Ward’s Wallet Watch’s liability to you
9.1. Any guidance provided will be based on the information that you give to Ward’s Wallet Watch, so it’s vital that you provide accurate and complete information about your circumstances and objectives. If you limit the information or you provide inaccurate, incomplete or misleading information it could affect the suitability of the guidance given. You agree that Ward’s Wallet Watch shall not be liable to you for any loss sustained in this manner.
9.2. By subscribing to use the Services, you unconditionally confirm that the details you provide to Ward’s Wallet Watch are true, fair and accurate in all material respects and comply with all applicable regulatory or statutory requirements. You agree to promptly notify Ward’s Wallet Watch of any material changes in relation to your details.
10. Legal and accounting advice
10.1. Ward’s Wallet Watch is not qualified to provide legal or accounting advice or to prepare any legal or accounting documents. This means that the onus is on you to refer any point of law or accountancy that may arise during the course of discussions with Ward’s Wallet Watch to a solicitor or accountant.
11. Your Personal Information
11.1. To provide the Services properly Ward’s Wallet Watch will need to collect information about your personal and financial circumstances. Your privacy is taken seriously and your personal information will only be used by Ward’s Wallet Watch to deliver the Services as obligated within this contract. Full details of what information is collected and its use can be found in the Privacy Policy. Using the Services and/or agreeing to these Terms, you accept Ward’s Wallet Watch’s practices regarding personal data and how Ward’s Wallet Watch will treat it.
11.2. Sometimes, Ward’s Wallet Watch may need to pass personal information relating to you to other organisations. Personal information relating to you may be transferred electronically (e.g. by email or over the internet) and Ward’s Wallet Watch, or any relevant third party, may contact you in future by what is believed to be the most appropriate means of communication at the time (e.g. telephone/ email /letter etc.).
11.3. The organisations to whom your personal information is passed by Ward’s Wallet Watch also have their own obligations to deal with your personal information appropriately and may have their own privacy policy setting out how they use personal data relating to you which it’s recommended you read carefully. In addition, a product or service may sometimes be administered from a country outside Europe. If this is the case, the organisation must put a contract in place to ensure that your information is adequately protected.
11.4. Your data or information will never be shared with any third party by Ward’s Wallet Watch except when it is directly required to provide the Services you have requested, as outlined in these Terms, or where you have given explicit permission in advance.
11.5. Personal data relating to you will be stored by Ward’s Wallet Watch using appropriate safeguards to maintain its privacy and security, as further outlined in Ward’s Wallet Watch’s Privacy Policy.
11.6. Under the terms of the General Data Protection Regulation (GDPR) you have the following rights:
11.6.1.You can ask for a copy of the personal information held about you. Ward’s Wallet Watch will provide this free of charge, unless your request is repetitive or excessive, in which case Ward’s Wallet Watch reserves the right to charge you a reasonable fee.
11.6.2. You can inform Ward’s Wallet Watch of any changes to your personal information, or of any corrections you would like made to any of the personal information held about you.
11.6.3. In certain situations, you can ask Ward’s Wallet Watch to erase the personal information held about you, or object to particular ways in which Ward’s Wallet Watch are using your personal information. Please note that Ward’s Wallet Watch may need to retain certain information for recordkeeping purposes, to complete any transactions that you began prior to your request, or for other purposes as required or permitted by applicable law.
11.6.4. Where Ward’s Wallet Watch is using your personal information on the basis of your consent, you are entitled to withdraw that consent at any time.
11.6.5. Where we process your personal information based on legitimate interest or the public interest, you have the right to object at any time to that use of your personal information.
11.6.6. You may exercise any of the rights set out in paragraph 11.6 by writing to emmaward@wardswalletwatch.com . For security reasons Ward’s Wallet Watch may ask for proof of your identity before it discloses information about you, or to you, via email or over the telephone.
12. Intellectual Property
12.1. Ward’s Wallet Watch owns all the intellectual property rights relating to the Services and the Website text (Wix is owner of the website designs, database, graphics and layouts and all proprietary software), and you agree not use or copy any part of them without express permission in writing.
12.2. You agree not to download, reproduce, copy, resell or exploit for any commercial purposes, any aspect of the Services, or to use automated means to download data provided to you as part of the Services (including without limitation, spiders, robots, crawlers or data mining tools, but excepting standard internet search engines).
12.3. You are not permitted to decompile or disassemble, reverse engineer or otherwise attempt to discover any source code contained in the Website.
12.4. You may only use the Services for your own personal, private and non-commercial purposes. You must not commercially exploit or sell any content appearing on Ward’s Wallet Watch’s Website or provided to you as part of the Services.
12.5. If you have a subscription to the Services, Ward’s Wallet Watch hereby grants you, and subject to these Terms, a non-exclusive, non-transferable right, to use Ward’s Wallet Watch’s financial planning software and financial coaching for your own personal, private and non-commercial purposes only. Whilst Ward’s Wallet Watch will do its best to ensure that this software and coach is accessible by you, this cannot be guaranteed, and Ward’s Wallet Watch also cannot guarantee that your use of the software and coaching will be uninterrupted or error-free. You agree that Ward’s Wallet Watch is not responsible for and shall not be liable to you for any problems or temporary interruptions you experience in using Ward’s Wallet Watch’s financial planning software or coaching.
13. Complaints
13.1. If you are unhappy with any guidance given by Ward’s Wallet Watch or any aspect of its services, we encourage you to contact Ward’s Wallet Watch as soon as possible.

You will receive an initial response as soon as possible, and Ward’s Wallet Watch will do as much as possible to resolve your concerns.
13.2. If you do have a complaint, and you are not happy with Ward’s Wallet Watch’s response, the Financial Ombudsman Service (FOS) may be able to help. The FOS settles disputes between financial services business and their clients. Full details are available at www.financial-ombudsman.org.uk.
14. Changes to these Terms
14.1. Ward’s Wallet Watch reserves the right to change or update these Terms from time to time to remain compliant with relevant laws and regulations and to ensure that Ward’s Wallet Watch is constantly improving your experience in using the Services. If you are a member of the Services, and any significant changes are made to these Terms, Ward’s Wallet Watch will notify you, and you shall have the right to end your subscription to the Services if you are not happy with the changes that we have made. Please see paragraph 8.3 above for details of what happens if you cancel your subscription to the Services. In this circumstance any unspent membership fee would be returned as long as the request for cancellation is made within 14 days of Ward’s Wallet Watch notifying you of the changes.
B. Legal Terms
15. General
15.1. These Terms shall be governed by and interpreted in accordance with English law. Disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the English courts.
15.2. No failure or delay to exercise, or other relaxation or indulgence granted in relation to, any power, right or remedy under these Terms shall operate as a waiver of it or impair or prejudice it nor shall any single or partial exercise or waiver of any power, right or remedy preclude its further exercise or the exercise of any other power, right or remedy.
15.3. A person who is not a party to this Contract shall not have any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of these Terms. This does not affect any right or remedy of a third party which exists, or is available, apart from that Act. The rights of the parties to terminate, rescind or agree any variation, waiver or settlement under these Terms are not subject to the consent of any other person.
15.4. Nothing in this Contract shall be deemed to constitute a partnership between the parties or any other person.
15.5. Each party shall at all times comply with all applicable laws and regulations of governmental or other competent authorities from time to time in performing its obligations under this Contract.
15.6. If any provision of these Terms is held to be illegal or unenforceable such provision shall be severed and the remainder of these Terms shall remain in full force and effect, unless the business purpose of the contract between us is substantially frustrated as a result.
16. Your rights to cancel the membership
16.1. For most services you have a legal right to change your mind within fourteen (14) days and receive a refund under the Consumer Contracts Regulations 2013. You will have fourteen (14) days after the Start Date to change your mind.
16.2.Subject to paragraph 16.1, if you cancel your membership within fourteen (14) days after the Start Date and:
16.2.1. you paid the Membership Fee by direct debit, Ward’s Wallet Watch will refund any payments received from you by transferring the relevant amount to your bank account; or
16.2.2. if you paid the Membership Fee via cash or bank transfer Ward’s Wallet Watch will either return the cash to you via your Coach or return its equal value via bank transfer as soon as possible:
16.2.3. You agree that Ward’s Wallet Watch may refund any payments received from you by transferring the relevant amount to such bank account as you direct;
16.2.4. You agree that you will report all untaxed income (that you will receive as a result of receiving any refund) to HMRC and pay any relevant taxes that become due; and
16.2.5. Indemnify Ward’s Wallet Watch for any loss or damage it suffers as a result of your failure to comply with paragraph 16.2.4 above.
16.3. You will not be entitled to a refund if you cancel after the first fourteen (14) days from the Start Date.
16.4. Please see paragraph 8.3 for details of what happens if you cancel your membership to the Services.
16.5. To exercise your right to change your mind, please contact Ward’s Wallet Watch by phone or e-mail, including the completed form below.

17. Membership Renewal
17.1. Membership is for a period of six (6) or twelve (12) months, and will renew automatically at the end of each membership period for the same length of time again, unless:
17.1.1. you inform Ward’s Wallet Watch in writing of your intention to end the membership (for further details about when you can end a membership and how to end a membership, please see paragraph 16 above);
17.1.2. if you have previously paid the Membership Fee via direct debit, which allows for automatic renewal of the membership, Ward’s Wallet Watch will issue a reminder to you at least fourteen (14) days before your membership automatically renews (and in the absence of any response from you, a further reminder at least one (1) working day before the membership renews), informing you that the membership will automatically renew and when it will renew.
17.2. If you wish to end the membership, you must inform Ward’s Wallet Watch in writing (by email or by post using the details in paragraph 16.5 above) before the membership automatically renews. Ending your membership will not remove you from the renewal reminder list, you must request removal from this list separately or you will continue to receive email reminders.
17.3. Unless you inform Ward’s Wallet Watch of your intention to end the membership in writing before the membership automatically renews, the membership will automatically renew, and Ward’s Wallet Watch will take payment for the Membership Fee as laid out in paragraph 17.1, as follows:
17.3.1. if you have previously paid by direct debit, Ward’s Wallet Watch will charge your account for the amount of the Membership Fee using the same direct debit details previously provided to Hatch; or
17.3.2. if you have previously paid via cash or bank transfer, Ward’s Wallet Watch will submit a request by e-mail or phone for the amount of the Membership Fee in order for your Membership to continue it is to be paid by seven (7) days from the end date of your membership.
17.4. Prior to the renewal date of your membership, you may change the payment method used to pay the membership fee for the next membership period by informing Ward’s Wallet Watch in writing of the new payment method that you would like to use.
C. FINANCIAL PLANNING SERVICE TERMS
Description
18. This service allows members to build a Financial Plan (or have one built for them) and discover how their wealth is set to change over time, whether they are on track to achieve their goals, and what actions they could take to improve their finances and improve their future finances. Different Financial Plans may be created to identify what would happen in different scenarios. Every element of the Financial Planning Service and Financial Coach Service play a key role in informing members’ so they can make decisions on how much to save, invest and contribute to their pensions or savings for retirement.
18.1. Disclaimer of Liability
18.2. Ward’s Wallet Watch is not regulated and authorised by the Financial Conduct Authority, use of the Financial Planning Service does not, in itself, constitute regulated financial advice.
18.3. The forecasts produced by Ward’s Wallet Watch are for illustrative purposes only and are not guaranteed. It is up to you to ensure that any information used to create the forecast is true and accurate. In addition, whilst Ward’s Wallet Watch uses all reasonable endeavours to ensure that the calculations on which your Financial Plan is based are accurate and reliable, there can sometimes be a delay in updating the calculations when there has been a change to the law or tax rules. As a result, any actions you take after viewing the Financial Plan should be based on:
18.3.1.your own further investigations;
18.3.2. the recommendations of a regulated service, as further described in Section F (Advisory Services); or
18.3.3. the advice provided by a third party regulated financial adviser.
18.4. Ward’s Wallet Watch can't be held liable for the consequences of any actions you take or fail to take, unless they are the direct result of advice that is given to you by Ward’s Wallet Watch in the course of Ward’s Wallet Watch providing Advisory Services (further details of which see Section F (Advisory Services) below). Ward’s Wallet Watch isn't responsible for any guidance, advice or recommendations given to you by a third party adviser, including any third party financial advisers to whom Ward’s Wallet Watch helps you engage with. If you choose to speak to a third party adviser, you may have to agree to additional terms and conditions which are independent of and separate to any terms or agreement with Ward’s Wallet Watch, and you may also have to pay additional charges.
D. FINANCIAL COACHING SERVICE TERMS
Description
19. Ward’s Wallet Watch will provide financial guidance to you. Financial guidance is the process of understanding your goals and financial circumstances and offering suggestions on what you could do to achieve those goals. Where relevant, Ward’s Wallet Watch will explain the different options available and outline the pros and cons of each. Ward’s Wallet Watch will explain your Financial Plan to you, answer questions, help plan your finances, give you general financial guidance and, where appropriate, tell you about regulated financial services. Every element of the Financial Planning Service and Financial Coach Service plays a key role in informing members so they can decide how much to save, invest and contribute to their pensions or savings for retirement.
19.1. About Your Financial Coach
19.2. The Coaches that deliver the Financial Coaching Service are full time employees of Ward’s Wallet Watch.
20. Coach Booking Services
20.1. Ward’s Wallet Watch will;
20.1.1. take bookings and requests from you to speak to a Financial Coach, or to amend or cancel such bookings;
20.1.2. keep a record of bookings.
20.2. To book a session with a Coach for the first time you can email emmaward@wardswalletwatch.com. You will receive a confirmation of your booking and the details of your Coach via email shortly afterwards.
21. Disclaimer of Liability
21.1. Financial Coaching is not an activity that is regulated by the Financial Conduct Authority, and the Coaches, as individuals, are not regulated by the Financial Conduct Authority either.
21.2. Coaches will not offer any advice that is regulated or conduct any other regulated activity, such as which funds to invest in, which mortgage or insurance products to purchase or whether or not to transfer a pension.
21.3.This means that it is your responsibility to ensure that the actions you take as a result of financial coaching are right for you.
21.4. You will not be covered by the government’s Financial Services Compensation Scheme if something goes wrong.
22. If you have more complex needs such that Ward’s Wallet Watch’s guidance Services are not suitable, then Ward’s Wallet Watch will notify you of what advisory services are available and what they can help with.
22.1. If you decide it would be beneficial you can ask for Ward’s Wallet Watch to take you through how to find the right service for you but Ward’s Wallet Watch can’t recommend one over any other.
22.2. Ward’s Wallet Watch is not responsible for any guidance, advice or recommendations given to you by a third party adviser.
22.3. If you choose to speak to a third party adviser, you may have to agree to additional terms and conditions which are independent of and separate to any terms or agreement with Ward’s Wallet Watch, and you may also have to pay additional charges.
E. MONITORING AND FEEDBACK SERVICE TERMS
Description
23. This service allows Ward’s Wallet Watch to ensure that your Coach adheres to quality standards and legal obligations. Ward’s Wallet Watch carry out ongoing monitoring and compliance checking of your Coach’s work, and will regularly request your feedback to help continue to improve the Services.
24. Your Feedback
24.1.Ward’s Wallet Watch is committed to offering a high quality service and always puts the members' needs first. If you have any feedback, questions or complaints then you may contact Ward’s Wallet Watch using the details set out in paragraph 2.1 above, and including the details of your feedback.
24.2. From time to time, we will request your feedback on Ward’s Wallet Watch. Your ratings, reviews and comments will help to continue to improve and develop the Services. You may leave a public review for Ward’s Wallet Watch at any time by going to Rate Me.
25. Coach Monitoring
25.1. Ward’s Wallet Watch is obliged to ensure that Coaches:
25.1.1. only provide financial information and guidance, and not regulated financial advice.
25.1.2. deliver the Financial Coaching Services in a way that meets quality and compliance standards.
25.1.3. are complying with their obligations.
25.2. Ward’s Wallet Watch will carry out ongoing monitoring and compliance case checks which may involve a member of the Ward’s Wallet Watch’s compliance team reviewing:
25.2.1. recordings of conversations you have had with your Coach;
25.2.2. e-mails and other written communication between you and your Coach; and
25.2.3. any financial plan built by, or approved by, your Coach.
25.3. To carry out these compliance checks, Ward’s Wallet Watch may require that your Coach shares your personal information with Ward’s Wallet Watch.
25.3.1. Any personal information you share with your Coach shall be stored securely and with sufficient safeguards to ensure it remains private, in line with the Ward’s Wallet Watch Privacy Policy and paragraph 11 of this agreement.
F. ADVISORY SERVICES TERMS
Description
26. This collection of services gives users access to services, tools, guides, including some product recommendations where relevant. In addition, Ward’s Wallet Watch may encourage you to:
26.1. get a legally binding will;
26.2. receive whole of market mortgage advice; or
26.3. receive whole of market insurance and protection advice; or
26.4. obtain advice from a third party financial adviser when your circumstances and requirements are outside the scope of Ward’s Wallet Watch’s service.

27. Investment Guidance
27.1. Ward’s Wallet Watch offer restricted investment guidance, which is limited to informing you of the different types of fund available, the risks associated and the benefits possible.
27.2. In addition, Ward’s Wallet Watch doesn’t provide advice or recommendations regarding the suitability of transferring an existing investment or pension.
27.3. The value of investments may go down as well as up, and you may not get back the amount invested. Levels of income from investments may fluctuate and past performance is not necessarily a guide to future performance. Ward’s Wallet Watch cannot be held liable for any depreciation in the value of investments arranged by you.
28. Your Money
28.1. For your additional security Ward’s Wallet Watch does not handle your money. Ward’s Wallet Watch never accepts cash or cheques made out to Ward’s Wallet Watch (unless it is a cheque in settlement of membership fees or other charges or disbursements for which Ward’s Wallet Watch has sent you an invoice).
29. Financial crime
29.1. Ward’s Wallet Watch is obliged to put in place controls to prevent Ward’s Wallet Watch from being used for money laundering and other forms of financial crime.
G. INVOLVEMENT WITH THIRD PARTY ADVISERS AND SERVICES
30. How the involvement will happen
30.1. Insurance and Protection and Mortgages
30.1.1. Ward’s Wallet Watchers who require financial advice regarding Insurance and Protection and/or Mortgages will be guided through the process of finding and choosing a specialist.
30.1.2. Ward’s Wallet Watch won’t recommend a specific service, you will have to make the choice and ensure you adhere to the new service’s own Terms and conditions and read their privacy policy if you enter into business with them.
30.2. Wills
30.2.1. Ward’s Wallet Watchers who require a Will will be guided through the process of finding a solicitor/online will writer.
30.2.2. Ward’s Wallet Watch won’t recommend a specific service, you will have to make the choice and ensure you adhere to the new service’s own terms and conditions and read their privacy policy if you enter into business with them.
30.3. Third Party Financial Adviser
30.3.1. Wallet Watchers who require independent financial advice will be guided through the process of finding a specialist.
30.3.2. Ward’s Wallet Watch won’t recommend a specific service, you will have to make the choice and ensure you adhere to the new service’s own terms and conditions and read their privacy policy if you enter into business with them.
31. Sharing personal data with third parties
31.1. If you wish for Ward’s Wallet Watch to help you with your interactions with a third party service Ward’s Wallet Watch will request permission from you to share some relevant personal information about you with the third party you’ve chosen. Sharing this information can help you have a better customer experience.
31.2. The personal data Ward’s Wallet Watch shares (with the user’s permission) is listed below:
31.2.1. Wills - no personal data will be shared
31.2.2. Mortgage Advice - Ward’s Wallet Watch will share the user’s name, approximate deposit amount, income and expenditure, and employment status.
31.2.3. Insurance and Protection - Ward’s Wallet Watch will share the user’s name, date of birth, basic health information e.g. BMI, income and expenditure, and outstanding debts (including mortgage amount).
31.2.4. Independent Financial Adviser - Ward’s Wallet Watch will share the user’s name, email address, phone number and a low level summary of the user’s needs for advice.
32. Sharing your Financial Plan with third parties
32.1. Ward’s Wallet Watch may also request permission from the user to share his/her Financial Plan with a Mortgage advisor, Insurance and Protection specialist and/or any Independent Financial Adviser to whom you enter into business. Ward’s Wallet Watch will never give a third party access to your Financial Plan without your explicit permission.
32.2. Having access to the user’s Financial Plan would help the adviser (in each case) to understand the user’s full circumstances, and therefore, offer the best advice that it can. The adviser would only be given access to the user’s Financial Plan whilst it is delivering a service to the user and its access to the Financial Plan would be rescinded as soon as the service has been delivered.
33. Receiving personal data from third parties
33.1. Whilst acting on a member’s behalf it is possible Ward’s Wallet Watch will be given or have to ask for personal information about you from the service being used. This information may impact the accuracy of your Financial Plan and will be used to keep your Financial Plan up to date. This include things like:
33.1.1. whether or not the user has completed his/her Will;
33.1.2. whether or not the user has taken out a mortgage or insurance product; and
33.1.3. basic information about products the user has taken out which would help Ward’s Wallet Watch update the user’s Financial Plan (e.g. monthly cost of the product, term of the mortgage, etc).
34. Disclaimer of Liability
34.1. Ward’s Wallet Watch isn’t responsible for any guidance, advice or recommendations given to you by a third party adviser, including any third party advisors Ward’s Wallet Watch supports you through, and you agree that Ward’s Wallet Watch won’t be liable for any loss or damage arising from any guidance, advice or recommendations given to you by a third party adviser.
35. Additional Terms
35.1. If you choose to speak to a third party adviser, you may have to agree to additional terms and conditions which are independent of and separate to any terms or agreement with Ward’s Wallet Watch, and you may also have to pay additional charges.
